ADA Improvements Pass Senate

by Mike Eastman

Today, the U.S. Senate passed the ADA Amendments Act, S. 3406, legislation that would amend the Americans with Disabilities Act to reverse court decisions that have interpreted the ADA’s definition of disability too narrowly.  This bill embodies a compromise reached between the business community and disability community and we are pleased that the Senate has taken this important step to restore a more appropriate interpretation of the ADA without imposing undue burdens on the business community.

In late June, the House passed similar legislation (H.R. 3915) that also embodies the compromise. However, it is not identical, so the bill must again return to the House for approval before it moves to the White House. We are hopeful that the House will move quickly so that this important bill can be enacted by the end of the year.
